1. The Defendant’s KRW 84,701,340 and the Plaintiff’s annual rate of KRW 6% from May 8, 2015 to December 10, 2015.

1. Basic facts

가. 원고는 2013. 10. 31. 피고와 사이에 성남 분당구 수내동 9-3 소재 지하 4층, 지상 14층인 분당 PEN 빌딩의 부지 및 건물(이하 ‘이 사건 기존건물’이라 한다) 중 당시 주식회사 케이티네트웍스에 임대된 지상 3층 55.2㎡를 제외한 나머지 부분을 임대차기간 기존임대차계약의 해지 효력발생일로부터 2년으로 정하여 피고에게 임대하는 내용의 임대차계약(이하 ‘이 사건 임대차계약’이라고 한다)을 체결하였다.

B. At the same time, the Defendant: (a) agreed with the Defendant to newly construct a new building by making the Plaintiff the same place as the owner at the time of remodelling the existing building in this case; and (b) entered into a contract with the Defendant to grant the Plaintiff the right to select a third party designated by the Defendant or the Defendant to purchase the existing building and the new building in this case (hereinafter “instant call options contract”) with the Plaintiff on the date of conclusion of the instant lease agreement; and (c) the key contents are as follows.

(2) The payment of the purchase price and the transfer of ownership of the subject real estate shall be no more than one month after the date of establishment of the sale contract of this case or less than the date on which the parties to the sale contract of this case agree separately.
