A defendant shall be punished by imprisonment for six months.
However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On October 2010, the Defendant in collusion with D, a contractor, applied for subsidies by submitting a false contract, tax invoice, certificate of deposit without passbook, etc. to the victim’s official in charge of the victim’s name, with the following: (a) the Defendant was paid KRW 40,779,00, which is the portion of the Defendant’s own shares ( KRW 20,389,000, KRW 20,389,000, KRW 20,389,50,000, which is the portion of the Defendant’s own shares) at the office of the specialized project team for agriculture in the entire city of Jeonju, located in the Jeonju, the Seoul Special Project Center; (b) at the G Haak located in the Seoul Special Project Group located in F, etc., prior to the Defendant’s operation.
However, in collusion with D from the beginning, the Defendant agreed to construct the facility with the amount equivalent to the subsidy that can be granted by the injured party, and the Defendant, as if he paid the amount equivalent to the Defendant’s contribution to the account of E, did not actually bear the amount equivalent to the Defendant’s contribution, and the actual construction cost of the said construction is limited to KRW 27,186,00, which is the amount equivalent to the subsidy.
Nevertheless, on October 7, 2010, the Defendant conspired with D to make a false statement to the victim, and received KRW 27,186,000 from the victim to the account of E around October 7, 2010, and acquired it by deceptive means, and received indirect subsidies of KRW 10,874,40 (the part concerning the “state expense” out of the above defrauded amount) by fraud.
2. On October 201, the Defendant, in collusion with H, a contractor, received KRW 25,01,50,00 of the construction cost of the greenhouse-circulating panty facility construction among the G cultivation pans located in Y in Y in the front city of Jeonju as of the Jeonju as of March 201, from J, the Defendant, the representative of I, to G cultivation pans located in Y in the front city of the operation of the Defendant, at KRW 25,01,00 of the total construction cost, from among the G cultivation pans in the front city of Jeonju as of March 201.
