1. Defendant A shall be punished by a fine of three million won;

Where the above defendant fails to pay the fine, 100,000 won.

Punishment of the crime

1. A recycling reporter of the defendant A shall install and operate recycling facilities in accordance with the standards for installation and operation prescribed by Ordinance of the Ministry of Environment (including storage tanks which can store livestock excreta generated from livestock pens for at least four months (120 days);

Defendant

A, from January 2, 2018 to December 31, 2018, operated a recycling business entity without installing a storage tank equivalent to 6,180 cubic meters from 51.5 cubic meters (=50 cubic meters x 120 cubic meters x 51.5 cubic meters x 51.5 cubic meters) for which the said foul waste can be stored for 120 days even though Co-Defendant B, a livestock excreta recycling business entity (reported as a recycling business entity on February 6, 2017), which is a livestock excreta recycling business entity in Jeju City, was engaged in collecting and disposing of livestock excreta equivalent to the average of 51.5 cubic meters per day.

2. Defendant B’s agricultural partnership committed the same offense as described in paragraph (1) against Defendant B’s business at the time and place specified in paragraph (1).
