A defendant shall be punished by imprisonment for six months.

Punishment of the crime

1. On July 9, 2018, the Defendant: (a) around 13:30 on July 9, 2018, the Defendant ordered the Victim C to pay the cost in the “E cafeteria” operated by the Victim D located in the Gu-si; (b) one white-ro (6,000 won); and (c) one group (4,000 won) one group (6,000 won) group (4,000 won) grouped.

However, the defendant did not have any intent or ability to pay the expenses even if he/she ordered food as above because he/she had no means of payment such as cash and credit card.

The defendant deceivings the victim as above and received food equivalent to 10,000 won in total at the market price from the victim, namely, from the victim.

2. On July 9, 2018, the Defendant: (a) around 18:30 on July 9, 2018, at the “H restaurant” operated by the victim located in G, the Defendant ordered the victim to pay one sea area (6,000 won) and two C (8,000 won) each week to the victim.

However, the defendant did not have any intent or ability to pay the expenses even if he/she ordered food as above because he/she had no means of payment such as cash and credit card.

The defendant deceivings the victim as above and received food equivalent to 14,00 won in total at the market price from the victim, namely, from the victim.

On May 22, 2018, the Defendant was provided with alcohol and food equivalent to KRW 28,000 in the sum of 28,000,000, namely, the “K cafeteria” operated by the victim J, which was operated by the Council of the victims, of the city of Cheong-si around 22:00.

However, the defendant did not have the intention or ability to pay the above food value to the victim because he did not possess money or a credit card which can be settled from the beginning.

Accordingly, the defendant did not pay the above amount of money even though he deceivings the victim and was provided with alcohol and food from the victim.
