A defendant shall be punished by imprisonment for one year.

Punishment of the crime

No person, other than an entrusted business entity, who is the Seoul Olympic Games Foundation or the Korea Sports Promotion Foundation or a person who is not an entrusted business entity, shall issue sports promotion voting rights or things similar thereto (including the issuance through an information and communications network) and provide property or financial benefits (hereinafter referred to as "similar act") to persons who win the result.

성명 불상자( 일명 ‘F’) 는 스포츠 토토와 유사한 사이트인 G 사이트 (H )를 개설하고 캄 보디아 똘 꼭 구 I 빌라에 위 사이트를 관리하는 사무실을 설치하여 위 사이트를 총괄 운영하고, 피고인과 J은 위 성명 불상자의 지시에 따라 위 사무실 운영을 총괄하고, K과 L은 위 사이트 운영 및 사무실 근무자를 총괄하고, M, N, O, P, Q, R, S, T, U은 서로 돌아가며 위 사이트 회원들 로부터 도금을 입금 받아 동액 상당의 사이버 머니로 충전해 주고 도박 결과에 따라 도금을 돌려주는 업무, 위 사이트의 게시판에 글을 게시하는 업무, 위 사이트에 경기 결과를 입력하고 종목마다 배당률을 조절하는 업무 등을 담당하는 등 각각 역할을 분담하여, 2015. 12. 23. 경부터 2016. 2. 5. 경까지 사이에 위 사이트에 가입한 회원들에게 각종 스포츠 경기 등의 승패 및 점수 차이 등을 예측하여 도금을 걸게 하고, 실제 경기의 결과에 따라 적중한 회원들에게는 송금 받은 도금에 배당률을 곱하여 환급하고, 적중시키지 못한 회원들 로부터 는 송금 받은 도금을 환수하는 방식으로 위 사이트를 운영하여 별지 범죄 일람표 기재와 같이 도금 명목으로 합계 3,666,494,580원의 입금 받아 합계 3,432,384,100원을 환급해 주었다.
