1. The Plaintiff’s appeal against the Defendants and the selective claim against Defendant A management body and B management body added at the trial.

Reasons

1. Basic facts

(a) Appendix 2 of the building A on the ground of the Seoul Special Metropolitan City, Seocheon-gu K-si;

Act on the Ownership and Management of Aggregate Buildings (hereinafter referred to as the " Aggregate Buildings Act")

b. Defendant A management body (hereinafter referred to as “Defendant A management body”) is a sectionally owned building, the use of which is determined as business facilities (officetels, offices), and Class I and II neighborhood living facilities.

(1) As to the building of this case, Defendant B’s management body (hereinafter “Defendant B management body”) consisting of all sectional owners.

(C) As regards the instant building 2, each of the sectional owners is a management body established on or around 2004 pursuant to Article 23(1) of the Aggregate Buildings Act, with all of the sectional owners as its members. C. The instant building 1 and 2 (hereinafter “each of the instant buildings”).

(E) On June 2007, all sectional owners hold a general meeting of occupants and elect representatives from each building, and then elect the representatives from each building, the E council of occupants’ representatives (hereinafter “the instant council of occupants’ representatives”).

D. The council of occupants’ representatives of the instant building constituted a group. The council of occupants’ representatives of the instant building: (a) elected the president and other officers; (b) entered into a service contract with controlled entities regarding the management of the entire building of the instant building; and (c) elected F as the president of the council of occupants’ representatives of the instant case on November 30, 209. E. The term of contract between the council of occupants’ representatives and the council of occupants’ representatives of the instant case on August 26, 2011 was set at KRW 21,49,000 per month to perform the management of the entire building of the instant case, including the imposition, collection and execution of management expenses, maintenance and management of facilities, parking, and cleaning management (hereinafter “the instant service contract”).
