1. Special robbery;

A. Defendant A solicited male victims who wish to be called “Semannam” on the ground of Ma, F, and G, a female juvenile, to take advantage of intimidation and to take out money by threatening them. Defendant A: (a) induced the victim to the telecom; and (b) F and G shared the role of raising money by assaulting and threatening the victim while entering the telecom with E and the victim’s maternal behavior; (c) inducing the victim to the telecom; and (d) raising money by assaulting and threatening the victim.

2013. 4. 18. 14:15경 대구 달서구 H에 있는 I모텔 부근에서, G은 스마트폰 채팅 어플리케이션인 ‘즐톡’에 접속하여 피해자 J(46세)에게 21살의 여자인데 15만 원에 조건만남을 하자고 하여 피해자를 위 모텔 근처 편의점으로 유인하고, 피고인 A은 렌트한 차량에 E, F, G을 태워 위 모텔 부근에 대기시킨 후 E을 약속장소 부근에 하차시키고, E은 그곳에서 피해자를 만나 위 모텔 606호로 피해자와 함께 들어간 다음 피해자가 샤워를 하는 틈을 이용하여 밖에서 대기하고 있던 피고인 A 등에게 문자메세지로 모텔명과 호실을 알려주었다.

그 후 F, G은 함께 위 모텔 606호실 문을 열고 들어가 G은 피해자에게 “이 씹할 새끼가 얘가 가출한 내 여동생인데 위치추적해서 겨우 찾아냈는데 내 여동생이 몇 살인지 아냐”라고 말하며 욕설을 하고, F는 스프레이통을 들고 피해자의 머리를 내리 찍는 시늉을 하며 “이 씹할 새끼가 안 꿇어”라고 하면서 피해자의 배 부위를 발로 찬 후 컴퓨터 자판기로 피해자의 머리를 내리치고 피해자가 무릎을 꿇고 앉자 발로 어깨부위를 1회 걷어차고, G은 다시 주먹으로 피해자의 가슴 부위를 1회 때린 후 피해자의 처 휴대폰 번호를 알아내어 “와이프에게 이 사실을 알려야겠다, 경찰에 신고한다”라며...
