A. On March 1, 2013, at around 20:45, the summary of the facts charged is as follows: (a) the Defendant was in a “G company” operated by the Defendant along with his husband E (52 years of age); (b) when the Defendant got her part of the neck from the victim due to a marital fighting, the Defendant she died of the brue. 나. 원심의 판단 원심은 피고인이 이 사건 당시 칼날 끝부분이 지면을 향하도록 칼을 쥔 상태에서 피해자와 실랑이를 벌인 사실이 있고, 실랑이 하는 과정에서 서로 계속 마주보고 있었으며 피해자가 칼에 찔린 후 쓰러질 때까지 계속 칼을 쥐고 있었다고 진술한 점, 피해자의 얼굴 여러 곳에 피부까짐 등이 발견되는 것으로 보아 당시 피고인과 피해자 사이에 몸싸움이 있었던 것으로 보이는 점, 피해자가 착용하였던 옷의 두께와 상처의 깊이 등에 비추어 칼에 상당한 외력이 작용한 것으로 보이는 점, 피해자의 상처와 피해자가 당시 착용했던 오리털 점퍼, 등산복 상의, 내복의 손상은 모두 한 방향으로만...
