A defendant shall be punished by imprisonment for six months.

Punishment of the crime

1. At around 11:00 on March 26, 2014, the Defendant listened to the victim’s speech that “I wish to move the present operating store” from the victim’s 1st floor B-9, and the victim’s “I see why I am now, I see good shops, and if I am more than the real estate broker than the real estate broker, I see that I would like to pay 5 million won deposit with the E bank account, which is the president of the real estate intermediary.”

However, the defendant, as a clothes broker, is not well aware of the circumstances of the store in the new and old circumstances, and is merely an E-do clothing seller, and is not a real estate broker, and even if he receives deposit, he/she did not have the intent or ability to introduce the store to the victim.

As above, the Defendant, by deceiving the victim, was transferred KRW 5,00,000 from the victim to the bank account (F) in the name of the bank account in the name of E as contract deposit around 11:17 March 26, 2014.

2. On March 28, 2014, the Defendant paid KRW 5 million additional deposit money to the victim, which reduces the victim’s good store at the above store, at around 09:40 on March 28, 2014.

However, the defendant did not have the intent or ability to introduce the store to the victim as above.

The Defendant, as above, by deceiving the victim as above, received 5,00,000 won from the victim as deposit money from the victim, that is, the Defendant was transferred to the above account.

3. On April 4, 2014, around 08:30 on April 4, 2014, the Defendant concluded a false statement that “The victim’s inside the above store is in harmony with the 3rd H-16 shop owner, and the said store may be leased. Instead, the Defendant concluded a false statement that “The store contract shall be concluded with the 10 million premium.”

However, the defendant was not only aware of C-3 H-16 shop owners, but also there was a lessee for the above shop.
