Reasons
1. Basic facts
A. The Plaintiff (formerly: Co., Ltd.) is a rearrangement project management contractor established on the basis of the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter “Urban Improvement Act”). The Defendant is a cooperative established pursuant to the Urban Improvement Act to promote B-Housing Redevelopment Improvement Project (hereinafter “instant project”). The Defendant’s overall promotion committee for B-Housing Redevelopment Development Project (hereinafter “Defendant Promotion Committee”) is an organization established for the establishment of the Defendant.
B. On August 21, 2006, the Defendant promotion committee applied for the approval of establishment establishment establishment establishment establishment establishment to the office of the Daegu-gu Seoul Metropolitan Government, the competent authority, and decided to hold a resident general meeting among 200 owners of land, etc. on December 13, 2006 and select the Plaintiff as a rearrangement project management company of the instant project.
C. On December 19, 2006, the Defendant Promotion Committee entered into a contract for specialized management of housing redevelopment project (hereinafter “instant service contract”) with the Plaintiff regarding the establishment of the Defendant and the implementation of the instant project. The main contents of the instant service contract are as follows.
[Specialized Management Services Contract for Housing Redevelopment ] In promoting a B-Housing Redevelopment Project located in the Nam-gu Seoul Metropolitan Government D, the Defendant Establishment Promotion Committee (hereinafter “A”) and the Plaintiff (hereinafter “B”) of the Specialized Management Business Center, a project implementer, enter into an agreement on a service contract for specialized Management Services following the implementation of a B-Housing Redevelopment Project as follows and the terms and conditions attached thereto.
1. Business name: The location of the redevelopment and rearrangement project for B houses: 29,230 square meters ( approximately 8,842 square meters) in Daegu-gu;
2. Terms and conditions of the contract: The agency for all administrative services on the execution of housing redevelopment and rearrangement project;
3. Contract term: From the contract execution date to the liquidation of the partnership;
4. Contract unit price: Standards for total floor area of business architecture; and
