1. The defendant shall be punished by imprisonment for six months;

Reasons
Punishment of the crime
1. On July 31, 2012, the Defendant was issued a summary order of KRW 1.5 million by the Gwangju District Court for a crime of violating the Road Traffic Act, and on October 26, 2012, the Defendant was sentenced to a fine of KRW 2 million by the same court, etc.
On March 26, 2015, at around 23:50 on the 26th day of Naju-si, the Defendant driven Crea with a alcohol level of about 1.7km from around the 1.7km section to the Gyeongnam-si road located in the same city-wide border.
2. Violation of the Road Traffic Act (AFS) provides that the Defendant is a person who is engaged in driving a vehicle under the CV.
On March 26, 2015, the Defendant driven the said car at a speed of 0.10% alcohol level of 0.10% on blood alcohol level around 23:50 on March 26, 2015, and proceeded at a speed of about 40km at the speed of about 110km in front of the shooting distance of the public library of the State.
At that time, there was a duty of care to prevent accidents in advance by checking whether another motor vehicle is already in the intersection after temporarily stopping or decreasing speed.
Nevertheless, the Defendant neglected this and found the E-car driven by the victim D, which was driven on the right side from the left side of the running direction of the Defendant’s vehicle, due to the negligence that the Defendant was under the influence of alcohol as above, late, and received the front side of the Defendant’s vehicle from the front side of the victim’s vehicle.
Ultimately, the Defendant did not take necessary measures such as providing relief to the victim by immediately stopping the vehicle, even though it was damaged to ensure that the amount equivalent to KRW 1,328,006 of the repair cost is equivalent to the above occupational negligence.
