1. Of the judgment of the court of first instance, the real estate stated in paragraph (1) of the attached list is based on the restoration of real name.
Reasons
1. Basic facts
A. The plaintiff is the child of the deceased C, the network D is the head of the net C, the plaintiff's punishment, and the husband of the defendant.
B. On July 27, 1981, pursuant to the former Act on Special Measures for the Registration, etc. of Ownership of Real Estate (Act No. 3094, effective), the Plaintiff filed an application for the subrogation of the change of the registered titleholder’s indication that changed F to F to C on February 3, 1971, based on the preservation of the right to claim the transfer of ownership on the ground of sale on February 3, 1971, pursuant to the former Act on Special Measures for the Registration, etc. of Ownership of Real Estate (Act No. 3094, effective), and filed an application for the registration of the subrogation of land subdivision with respect to E-mail 249 square meters (823 square meters) and 175 square meters
Accordingly, the land of the said E-Y 249 square meters (823 square meters) was divided into the said G G 204 square meters (674 square meters) and H 41 square meters (136 square meters) and 13 square meters (13 square meters), which is the land listed in paragraph (1) of the attached Table No. 1 of the attached Table (hereinafter “the land of this case”). The said J 175 square meters (57 square meters) was divided into the land listed in paragraph (2) of the attached Table No. 2 of the attached Table (hereinafter “the land of this case”) and the land of the said J 171 square meters (565 square meters) and L 4 square meters (13 square meters), respectively.
C. On July 27, 1981, the Plaintiff completed the registration of ownership transfer on the land Nos. 1 and 2 due to sale on February 3, 1971 pursuant to the former Act on Special Measures for the Registration, etc. of Ownership of Real Estate (Act No. 3094).
On June 26, 1995, the Plaintiff’s death net D completed the registration of ownership transfer for reasons of sale on April 3, 1985 pursuant to the former Act on Special Measures for the Registration, etc. of Ownership of Real Estate (Act No. 4502, invalidation, etc.) with respect to the land No. 1 of this case, and completed the registration of ownership transfer for reasons of sale on December 6, 1976 under the Act on Special Measures for the Registration of Ownership for Land No. 2 of this case. At the same time, the guarantor of each guarantee letter was Ma, N, O.
E. On October 15, 2012, the Defendant completed the registration of ownership transfer on the land Nos. 1 and 2 of this case due to a consultation and division.
