1. Of the instant lawsuits, the part of the claim to nullify the decision to refuse the promotion of associate professors shall be dismissed.
2. The plaintiff's remainder.
Reasons
1. Basic facts
A. 1) The Defendant, based on the educational ideology of the Republic of Korea, is a school foundation with the aim of providing higher education in order to train traders who are dedicated to the new subject and the advanced education in order to study the profound theories and reality of science necessary for the new subject and the advanced education, and is establishing and operating C University. On March 1, 2010, the Plaintiff was appointed as an assistant professor of C University for a period of four years of employment on February 28, 2014. (2) The Plaintiff was expected to expiration on February 28, 2014, but the Plaintiff was notified on September 26, 2013 that the term of appointment of the Plaintiff would expire at the expiration of the term of appointment of the assistant professor of C University for a four-year term and that it would be subject to examination of the promotion of associate professors according to the faculty personnel management regulations.
B. On January 20, 2014, with regard to the proposal for promotion of the president of Cuniversity, the 1 Cuniversity teachers’ personnel committee, on December 19, 2013, decided to examine the Plaintiff’s research performance for the examination of promotion from January 2, 2014 to the 15th day of the same month in relation to the “case related to promotion of the first semester” as of December 19, 2013, and the examination committee as a research performance examiner shall be D professors, and the examination committee as a research member shall be in contact with the three candidates, such as E professor, and the examination committee as of January 16, 2014 decided to conduct a promotion examination with the Plaintiff on January 16, 2014, taking into account the research performance and the examination period.
2 C. On January 16, 2014, the Personnel Committee for Faculty Members of the C.C. may request the second-class professor to examine procedural defects related to the selection of examiners of research records for the examination of promotion of the plaintiff on January 16, 2014.
1. By no later than 9 A.M., a decision was made to receive the results of the examination.
3. On January 20, 2014, the Cuniversity teachers' personnel committee decided that the Plaintiff's thesis evaluation meets B average and that the Plaintiff's thesis evaluation exceeds average of 80 points as a result of the evaluation of teachers' personnel management committee, passed the Plaintiff's examination of appointment of associate professor with 4 votes and dissenting 1 votes.
However, the C University held on January 20, 2014.
