1. The Defendant shall pay to the Plaintiff KRW 4,457,762 as well as 15% per annum from April 7, 2017 to the date of complete payment.
Reasons
On January 22, 2007, the Plaintiff: (i) leased KRW 15 million, monthly rent of KRW 730,000,000; (ii) on December 7, 2009, KRW 15,502 of the lease deposit; (iii) monthly rent of KRW 730,000,000; and (iv) on December 7, 2014, after acquiring the ownership of the above ground building around December 31, 2014, succeeded to the lessor status of the above lease; (iv) the Defendant paid KRW 401 and 502 from the Plaintiff on January 31, 2015; and (iv) the Defendant did not receive KRW 1052,300,000,000,000 from the Plaintiff as indicated in the attachment; and (v) the Defendant did not receive the said lease deposit from the Plaintiff on January 31, 2015.
Therefore, the Defendant is obligated to pay to the Plaintiff the remainder of KRW 457,762 of the lease deposit (i.e., KRW 30 million of the lease deposit - KRW 15 million of the term payment - KRW 10,542,238 of the attached Form 10,542,238 of the attached Form) and damages for delay at the rate of 15% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from April 7, 2017 to the date of full payment.
Thus, the plaintiff's claim of this case is justified and accepted.
