A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
The Defendant, at the end of July 29, 2016, paid KRW 200,000,000 in total, borrowed money from creditors D, and entered into a new lease agreement with the Defendant at risk of being subject to compulsory execution, with the intention of avoiding compulsory execution. On July 31, 2016, he/she concealed the Defendant’s lease deposit amount of KRW 60,000,000 and KRW 140,000,000 borrowed money borrowed from the Defendant’s mother’s name and the Defendant’s mother’s name and/or KRW 1,40,000,000,000 borrowed money borrowed from creditors D, and entered into a new lease agreement with the Defendant under the name of the Defendant by entering into the lease agreement under the actual lessee’s name.
The defendant of "2017 Highest 2680" is a person who was the representative director of G Co., Ltd.
On January 6, 2016, the Defendant: (a) obtained a loan of KRW 84,00,000 from the Victim K Savings Bank to pay the principal and interest for 60 months from January 6, 2016 to January 10, 2021; and (b) agreed on January 6, 2016, the mortgagee against the foregoing vehicle as the victim; (c) the debtor as the corporation, the debtor as the corporation, and the bond value of KRW 84,00,000,000.
Nevertheless, on October 2016, the Defendant, without paying the full amount of the loan, concealed the said vehicle, which became the object of a mortgage, to I, and thereby interfered with the exercise of the right by the victim.
