1. The Defendant’s KRW 38,314,50 for the Plaintiff and KRW 15% per annum from May 17, 2019 to May 31, 2019 for the Plaintiff.
Reasons
1. Indication of claims: It shall be as shown in attached Form; and
2. Judgment without holding any pleadings (Article 208 (3) 1 of the Civil Procedure Act);
3. The statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings was amended on May 21, 2019 and enforced on June 1, 2019. Since the statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings was changed to 15% per annum until May 31, 2019 and 12% per annum from the next day, the portion exceeding 12% per annum out of the Plaintiff’s claim for delay damages after June 1, 2019 is dismissed.
