Reasons
Punishment of the crime
1. The Defendant, at around 01:00 on July 20, 2017, borrowed KRW 1.530,000, received a large amount of loans in the name of women-friendly Gu, women, regardless of the victim’s intent or ability to repay the money.
In doing so, if a woman-friendly parent loaned cash with no high credit rating, he/she would receive a loan from the female-friendly Gu with a higher credit rating, and would pay the above money in return for the loan, and he/she received 1,530,000 won from the damaged person to the bank account under the name of the defendant C bank account (D).
Accordingly, the defendant deceivings the victim and defrauds the above KRW 1,530,000.
2. On July 22, 2017, the Defendant acquired pecuniary profits, such as the cost of short-term phone calls, from the trade name in North Korea on July 22, 2017, the victim made a false statement to the victim that “if the mobile phone is opened in the name of the driver, the fee will be paid in full, regardless of the victim’s intention or ability to pay the short-term cost and the user fee,” and the victim made the victim open the cell phone in the name of the driver, and then the victim bears KRW 579,580,00 of the user fee, after having the victim open the cell phone in the name of the victim.
Accordingly, the defendant, by deceiving the victim, acquired a total amount of 1,732,380 won property interest.
3. On July 24, 2017, the Defendant, through fraud (G agency) by means of pecuniary profits, such as the cost of short-term phone calls carried by the Defendant (G agency) on July 24, 2017, is a G agency located in the Yansan-gu prior to the lapse of July 24, 2017, despite the absence of intent or ability to pay a short-term terminal cost and a fee even if a mobile phone was opened and delivered through a mobile phone from the victim’s name, he/she prepares money via a mobile phone because the victim’s living cost is insufficient.
