1. At night, the Defendant: (a) had been working for one month at “E” operated by the victim D in Dongdaemun-gu Seoul, Dongdaemun-gu; (b) had the victim attend a simple safe with cash; and (c) had the victim committed a theft.

On March 2, 2015, at around 21:30, the Defendant: (a) opened a locked door using a security card, etc. prepared in advance; (b) went into the said office; and (c) went into the said office; and (d) cut off the cash owned by the victim, which was kept in a simple safe and a book on the upper half of the said office.

2. No person who violates the Electronic Financial Transactions Act shall transfer the means of access in using and managing the means of access;

Nevertheless, around February 2015, the defendant transferred the passbook, physical card, and password connected to the company bank account (F) in the name of the defendant before the exit of five times in Seoul Special Metropolitan City, Nowon-gu, Seoul Special Metropolitan City.

Accordingly, the Defendant transferred to another person the means of access opened in Defendant’s name.

3. On January 2015, the Defendant violated the Electronic Financial Transactions Act (hereinafter “Electronic Financial Transactions Act”) transferred the means of access by delivering a physical card connected to the Defendant’s agricultural bank account (I) in front of the H Hospital G in Gangseo-gu Seoul, Gangnam-gu, by using Kwikset Service, and by providing information on the password of the said physical card by telephone.

4. The Defendant: (a) around 21:00 on March 17, 2015, in L China’s restaurant operated by the Victim K in Gangnam-gu Seoul, Seoul, working as a delivery source in the above Chinese restaurant from around the morning on the same day; and (b) was able to collect food prices on behalf of the victim and settle the case with the victim.
