A defendant shall be punished by imprisonment with prison labor for up to six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On August 8, 2019, at around 15:25, 2019, the Defendant embezzled: (a) from an infinite person who assumes the name of the lending company’s employee B, “a loan may be made if the lending company does work as if the lending company incurs income; (b) to send a copy of the account to receive remittance money in the name of the lending company’s employee; (c) to request the sending of a copy of the account to receive remittance money; (d) to the cell phone by printing up the screen on which the information of the Cbank (D) is written in the name of the Defendant’s name is recorded; and (d) to send a cell phone to an infinite person; and (e) to the 6 million won from
Although the Defendant perceived that the above KRW 6 million was the amount of damage caused by telecommunications-based financial fraud, the Defendant embezzled the said amount by arbitrarily consuming it by transferring the said amount to the F (G) account under the name of the Defendant, thereby using it for gambling.
2. No person who violates the National Sports Promotion Act shall gambling, using property or property benefits to persons who win at the betting ballots or similar things issued by a person, other than the Seoul Olympic Sports Promotion Foundation or an entrusted business entity, and win at the betting.
Nevertheless, on August 5, 2019, the Defendant connected to the “H” site (I), a private sports gambling site, and transferred KRW 500,000 to the Cbank account (K) account in the name of the Defendant from F (G) to the above H’s account in the name of the Defendant, which is the charging account of the said H (H) site, deposited the amount of cyber money, and predicted the outcome of the sports games, such as domestic and foreign stables, deaf-gu, and camping districts, and gambling by means of receiving dividends according to the dividend rate if the prediction is significant, as shown in the attached list of crimes from around August 8, 2019 to around August 8, 2019.
