A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On August 24, 2006, the Defendant was issued a summary order of KRW 1 million for a crime of violating the Road Traffic Act (drinking driving) at the Jeonju District Court’s Eup branch on August 24, 2006, and on April 5, 2017, the Defendant was issued a summary order of KRW 2 million for a crime of violating the Road Traffic Act (drinking driving) at the Seoul Northern District Court (e.g., February 16, 2017). The Defendant was under the influence of alcohol concentration of KRW 0.077% during blood around 18:40 on March 19, 2017; the Defendant was driving a string-man car from the pharmaceutical car located in Gyeyang-gu, Gyeyang-gu, Seoyang-gu to approximately 423-1 of the same Gu wall 423-1.

Summary of Evidence

1. Statement of the circumstances of the driver at the main place of business, and statement of alcohol concentration in the blood;

1. Investigation report (in relation to the application of the above Dmark official numerical value);

1. References to inquiries, such as criminal history, reporting on the results of dispositions and reporting on the results thereof, and the application of Acts and subordinate statutes;

1. Relevant Article of the Act and Articles 148-2 (1) 1 and 44 (1) of the Road Traffic Act concerning the facts constituting an offense;

1. Articles 53 and 55 (1) 3 of the Criminal Act to mitigate small amount;

1. Article 62 (1) of the Criminal Act on the suspended execution;

1. The punishment as ordered shall be determined in full view of the records of drinking as stated in the grounds for sentencing Article 62-2 of the Criminal Act, the time of the crime, the measurement of drinking, the degree of reflection thereof, the circumstances leading to the crime, the character and conduct of the accused, the environment, etc.;
