1. As to KRW 127,30,000 among the Plaintiff and KRW 110,00,000 among them, the Defendant shall start from June 26, 2013 to July 3, 2018.

Basic Facts

On September 1, 2000, the Plaintiff leased KRW 30 million to the Defendant on December 31, 2001.

On June 26, 2013, the Plaintiff remitted KRW 50 million to the Defendant. On the same day, the Defendant prepared and delivered to the Plaintiff the loan certificate (Evidence A 3; hereinafter “the instant loan certificate”) as of August 30, 2013, which was set forth by the loan certificate as of KRW 110 million and due date.

Upon the Defendant’s request, the Plaintiff transferred KRW 10 million to the Defendant’s A’s account on July 4, 2013, KRW 1 million to the Defendant’s account on October 17, 2014, KRW 1.3 million to D’s account on December 29, 2014, KRW 1.3 million to D’s account on December 29, 2014, and KRW 5 million to D’s account on January 27, 2015.

[Ground for recognition] Under the circumstance where no dispute exists, Gap evidence Nos. 1, 2, and 3's assertion of the purport of the entire pleadings, and determination as to the claim for loans 10 million won on the loan certificate of this case, the plaintiff lent to the defendant with a loan of KRW 30 million on September 1, 200, and KRW 50 million on June 26, 2013, and the defendant prepared and paid the loan certificate of this case with KRW 110 million on June 26, 2013 and KRW 110 million on the loan certificate of this case with KRW 30 million on the loan of KRW 150,000,000 from September 1, 200, KRW 1010,000 on the loan of this case, KRW 30,000,000 on the loan of KRW 10,000 on the loan of this case to KRW 160,000,000 on the loan of this case.

In regard to this, the defendant defense that 30 million won of the loan claim as of Sep. 1, 2000 expired, and therefore, the defendant asserted that 30 million won of the loan claim as of Sep. 1, 200 expired, and the fact that 31 December 2001 of the repayment period of the above loan claim is as seen above.
