1. The Defendant’s KRW 25,00,000 as well as the Plaintiff’s annual rate of KRW 5% from February 14, 2014 to October 13, 2016.
Reasons
1. Basic facts
A. On January 26, 2014, the Plaintiff entered into an agreement with the Defendant on the prohibition of the right to sports grounds and the transfer of the right to sports grounds (hereinafter “instant agreement”) with respect to the acquisition and operation of Taekwondo gymnasiums (hereinafter “the instant sports center”) in which the Defendant was operating.
In relation to the lease of a sports center building, the defendant is responsible and the plaintiff was entered into a lease agreement with the lessee.
According to the instant contract, the Plaintiff paid 10 million won to the Defendant on January 26, 2014, which is the date of the contract, and the intermediate payment of 30 million won to the Defendant on February 14, 2014, respectively, and on February 26, 2014, the remainder of 45 million won was paid as of February 26, 2014. Meanwhile, at the time of the contract, gymnasium trainees shall be based on 140 persons, and up to five students who retire from the contract to the date of the remainder payment, the Plaintiff paid 60,000 won per worker short of 135 persons if the trainee is less than 135 persons, and the Plaintiff decided to confirm the number of trainees from the date of the intermediate payment to the date of the remainder payment.
The Plaintiff paid 10 million won to the Defendant on January 26, 2014, which is the date of the contract under the instant contract.
B. After entering into the instant contract, the Defendant, from February 5, 2014 to February 12, 2014, had trainees registered during the pertinent period attend free of charge for two months on the first month registration fee, and had them hold events that include the details of providing education free of charge for advanced English sports in the U.S. Europe (hereinafter “instant event”).
The Defendant created and distributed a leaflet while holding the instant event.
C. On February 10, 2014, in order to verify the number of students, the Plaintiff was set off a daily number of trainees as the instant sports center. However, at the time, the Defendant was at the time.
