Punishment of the crime

[criminal history] On September 22, 201, the Defendant was issued a summary order of KRW 2 million for a crime of violating the Road Traffic Act (drinking driving) in the support of the Suwon Frigwon, and on December 28, 2016, the Defendant was issued a summary order of KRW 4 million for a crime of violating the Road Traffic Act (drinking driving) at the Seoul Central District Court.

[Criminal facts]

1. Notwithstanding the fact that the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from Dbening Driving), the Road Traffic Act (Dbening Driving) and the Road Traffic Act (non-licenseless Driving) not only twice or more, but also did not have a driver's license at that time, the Defendant driven a Dbenz MWz350 car with a alcohol concentration of 0.248% on May 12, 2017, while driving a motor vehicle with a alcohol content of 0.248% at around 22:30 on May 12, 2017, and proceed as the Seocho-gu Seoul Metropolitan City Epick, as the Seoul Seocho-gu Epick, into a distribution intersection.

당시 피고인은 언행상태가 부정확하고, 보행상태는 불안하였으며, 얼굴이 홍조를 띠면서 빨갛게 부어올랐을 정도로 술에 취하여 전방과 좌우를 면밀하게 살피지도 못하고 조향장치나 제동장치 등을 정확하게 조작하지도 못함으로써, 같은 방향 3 차로에서 4 차로로 진로를 변경하고 있는 피해자 F(52 세) 운전의 G 레이 승용차의 조수석 쪽 앞 펜더 부분을 위 벤츠 ML350 승용차의 앞 범퍼 부분으로 들이받은 다음 같은 방향 4차로 전방에서 진행하고 있는 피해자 H(49 세) 운전의 I 제네 시스 승용차의 뒷 범퍼 부분을 위 벤츠 ML350 승용차의 앞 범퍼 부분으로 들이받고, 계속하여 진로를 변경하다가 같은 방향 3 차로를 진행하고 있는 피해자 J(56 세) 운전의 K 무쏘 승용차의 뒷 범퍼 부분을 위 벤츠 ML350 승용차의 앞 범퍼 부분으로 들이받았다.

Accordingly, the defendant is in a state where normal driving is difficult due to influence of drinking without a driver's license.
