Punishment of the crime

[Criminal Power] On December 27, 2012, Defendant A was sentenced to one year of imprisonment with prison labor and two years of suspended execution for violating the Punishment of Violences, etc. Act at Seoul Southern District Court (joint injury) and the judgment became final and conclusive on January 4, 2013.

【Criminal Facts】

1. Around January 29, 2010, Defendant B owned the fourth floor of the Hacheon-si Hju Complex Building in the name of G, Seocheon-gu, Seocheon-gu, Hocheon-si, and was in possession of the fourth floor above, Defendant B tried to find out the victim I who was restricted from exercising the right of retention due to the victim I (the age of 42) who had previously been holding the right of retention on the fourth floor.

3. 초순경 사이에 H주상복합건물 2층에 있는 상호불상의 당구장에서 A을 만나 “내가 H주상복합건물 4층 전체를 8억 정도에 샀다. 그런데 I과 아들, 딸이 유치권을 행사한다고 점유하고 있다. 내보내 주면 1억 원을 주겠다”고 제안한 뒤 A으로부터 이를 승낙받자 2010. 3. 일자불상경 위 당구장 및 서울 영등포구 문래동에 있는 상호불상의 골프연습장 등지에서 A에게 수차례에 걸쳐 “빨리 해서 어떻게든 내보내라. A이 I이보다 힘이 세잖아. 빨리 좀 I을 쫓아내라”는 취지로 말하였다.
