A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[Attachment] On December 19, 2008, the Defendant was issued a summary order of KRW 2 million for a crime of violating the Road Traffic Act (driving) at the Goyang Branch of the Jung-gu District Court on December 19, 2008. On December 2, 2014, the Defendant was issued a summary order of KRW 3.5 million for the same crime by the same court.

【Criminal Facts】

1. The Defendant is a person engaging in driving a Csch Rexton car.

On July 30, 2015, the Defendant driven the said car on July 30, 2017:45, and led the two-lanes of the three-lane intersections in front of the oil station in Ejuju City, which are located in D at D, by moving the two-lanes off from the enclosed bank to the Jal Receiving Apartment.

However, in this case, a person engaged in driving of a motor vehicle has a duty of care to observe the lanes and to prevent traffic accidents in advance by emphasizing the right and the right of the road.

Nevertheless, the Defendant neglected this and received the part of the Defendant’s motor vehicle left ahead of the left side of the motor vehicle by Gribero, which was going through the signal at the above intersection, in order to turn to the left left at the bend of the day, due to the negligence of the median line while under the influence of alcohol without a driver’s license as set forth in the following Paragraph 2.

Ultimately, the Defendant, due to the above occupational negligence, destroyed the above vehicle owned by the victim H to the extent equivalent to KRW 1,650,615, and escaped without taking necessary measures.

2. On July 30, 2015, the Defendant driving a motor vehicle under the influence of alcohol two or more times, such as the foregoing criminal power, and around 7:50 kilometers from the Do in front of distribution of the Republic of Korea in the Geumcheon-gu, Jeoncheon-si, Pakistan, on July 30, 2015, to the roads prior to the reception of the wave located in the Geumcheon-gu, Jeoncheon-si.
