The defendant, from 17,144,100 won to 17,100 won, shall be prepared in attached Form from September 24, 2016 to 200.

Facts of recognition

On April 12, 2013, the Plaintiff: (a) specified and leased the part on the indication of the attached drawings (A) among the land on the real estate listed in the attached list as KRW 80,00,000 from May 20, 2013 to May 19, 2016; (b) specified and leased the deposit as KRW 2,60,000 from May 20, 2013 to May 19, 2016; and (c) specified and leased the part on the attached drawings (B) as KRW 20,00,000 from May 20, 2013 to May 19, 2016, as well as KRW 1,00,000 from the rent month to May 20, 2016 (hereinafter referred to as “instant lease agreement”); and (d) determined and leases all taxes incurred from the operation of a Class 1 workplace due to a special agreement.

After May 20, 2014, each monthly rent of KRW 200,000 shall be applied (i.e., the total rent of KRW 4,000,000, including value-added tax, and KRW 4,400,00,00, including value-added tax).

However, the Defendant’s operation of entertainment bars, etc. in the leased object is classified into Class 1 workplace, and the Defendant imposed KRW 65,609,150 on the aggregate of the amount of heavy taxation on land and buildings from July 2014 to September 2015.

On the other hand, on May 23, 2016, the rent and tax charges that the Defendant is obliged to pay to the Plaintiff by 162,819,730 won in total, and 228,428,880 won in combination of the above heavy tax amount (65,609,150 won in total), and the Defendant paid KRW 173,750,000 among them.

In addition, the amount equivalent to the rent that occurred between May 24, 2016 and September 23, 2016 was 17,60,000 won (4,400,000 won x 4 months), management expenses were 1,040,790 won for management expenses, and 34,536,230 won for taxes and public charges, including heavy taxes, were 53,17,020 won for total amount. The defendant paid 25,00,000 won among them.

[Ground of recognition] In light of the above facts without dispute, Gap 1 through 7 evidence, Eul 1 through 4 evidence (including numbers), and the judgment of the court below as to the ground of claim of the whole pleadings, the plaintiff is liable to pay the heavy tax amount.
