A defendant shall be punished by imprisonment for one year.

Punishment of the crime

[2] On September 24, 2015, the Defendant was sentenced to imprisonment for the same crime at the Gwangju District Court on November 11, 2015, and the execution of the sentence was completed on June 24, 2016 at a wooden prison.

[Criminal facts]

1. On February 9, 201, the Defendant, in violation of the duty to maintain the utility of an electronic device, was issued a five-year order to attach a location tracking electronic device for committing a violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (rape, etc. against a disabled person) in the Southern Branch of the Gwangju District Court (hereinafter “Seoul District Court”), and according to such decision, the Defendant is under execution of an electronic device attachment order until August 1,

A person with an electronic device installed shall not arbitrarily separate, damage, interfere with propagation of, alter data received from his/her body, or impair its utility during the period of attachment of the electronic device.

A. However, on January 23, 2017, the Defendant left all of the portable tracking devices from around 01:49 to 02:29 of the same day.

B. On April 21, 2017, the Defendant, from around 13:58 to 14:18 of the same day, had the Defendant deviate from the scope of the attachment device because he/she did not arbitrarily separate and carry the portable tracking device from his/her body.

On February 1, 2018, the Defendant, from around 00:16 to 03:03 of the same day, had a portable tracking device separated from his body at will and failed to carry the tracking device, leaving the scope of responding to the attachment device.

The Defendant, in a total of three times, has impaired the utility of electronic devices.

2. A person subject to the duty to observe an electronic device or a person subject to the duty to observe shall abandon bad habits leading to a crime, perform the preceding duty, and comply with the direction and supervision of persons who are likely to commit a crime, as well as the instructions and supervision of the protection observation officer, and comply with the matters to be observed under the Act on the Protection, Observation, etc. of Persons To be able to respond when visiting;
