A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

[criminal record] On June 12, 2015, the Defendant was sentenced to a suspended sentence of one year for four months by obstructing the performance of official duties in the Incheon District Court’s Branch Branch.

[ 범죄사실] 피고인은 경기 성남시 C 시장 일대에서 D 포터 화물차를 이용하여 뻥튀기 노점을 운영하는 뇌 병변 3 급 장애 보유자로, 노점 단속을 당하는 등의 이유로 생활의 어려움을 겪게 되자, 위 화물차에 평소 사용하던 휘발유와 액화 석유 가스통을 싣고 청와대로 가 액화 석유 가스통을 폭발시키거나 휘발유로 분신하는 방법으로 자살을 시도하는 등 불만을 표현할 것을 결심하였다.

1. On October 28, 2016, at around 23:00, the Defendant obstructed the performance of special official duties using cargo vehicles, driving the cargo vehicle at the above Poter, and was in the “new inspection station” in the Seoul Jongno-gu Clean Movement, Jongno-gu Seoul Central Police Agency employees of the said inspection station: (a) the Defendant was prevented from proceeding in the direction with the audience; and (b) the Defendant was demanded to stop for the purpose of inspection by receipt; (c) but (d) the Defendant did not comply with the demand and continued the said cargo vehicle, as it would inflict any harm on his body.

Accordingly, the defendant, using the above cargo vehicle, who is a dangerous object, threatened a slope F who is a police officer, thereby hindering his legitimate execution of duties concerning his office guard.

2. The Defendant, while driving a cargo vehicle, failed to comply with inspection as described in paragraph 1 and obstructed the Defendant’s performance of official duties by using gasoline, liquid petroleum gas (LPG), was unable to drive the cargo vehicle, thereby blocking the path by the patrol vehicle of G Drivingman in Seoul Jongno-gu EF Police Agency, Seoul, who called out to the relevant area, and making it impossible to proceed with the cargo vehicle any longer due to the slope H of the same expense.

Accordingly, the Defendant opens two valves via liquefied petroleum gas, which is loaded in the cargo vehicle, after unloading from the cargo vehicle.
