1. The Defendant’s KRW 749,920,877 within the limit of KRW 975,00,000 for the Plaintiff and the Defendant’s payment from February 19, 2013.
Reasons
1. Facts of recognition;
A. The Korea Savings Bank (hereinafter “Korea Savings Bank”) and the U.S. Forest Co., Ltd. (hereinafter “Korea Savings Bank”), and the Defendant are preparing a loan application, a credit transaction agreement, and a letter of debt acquisition agreement with the following content.
1) The amount for which a loan application is applied: 750,00,000, interest rate: 11% per annum: Assumption of obligation, name of the borrower: The name of the borrower, the relationship with the defendant and the joint guarantor: The representative director: June 30, 2010; the borrower: 750,000,000,000, and the starting date of the loan: August 2007; 11% per annum; 23% per annum; and 33% of the date of undertaking the obligation of the loan: the creditor: Han Savings Bank; the debtor; and the YYY Co., Ltd. (hereinafter referred to as the “SAP”).
(2) A person who assumes the obligation: The indication of the obligation under the U.S. Forest and the original agreement: The agreement on August 31, 2007, the principal of which is 750,000,000 won, and the grant of the obligation.
B. The following is written between the Defendant and the Korea Savings Bank:
Date: On June 30, 2010, a joint and several sureties: The defendant, the content of the guaranteed obligation: the debtor's U.S. bond, limited collateral guarantee within the scope of the guaranteed obligation, the limit of the guaranteed obligation: 975,00,000 won, and the period for the settlement of accounts for probation guarantee: Future designation.
C. On August 20, 2010, the U.S. Forest changed its trade name to the Masan Development Co., Ltd. (hereinafter “Masan Development”). D.
The extension of the due date of credit between the Korea Savings Bank and the defendant is prepared.
Terms and conditions of credit to be changed: Loans of general funds for the subject of credit, limit of credit 750,00,000, and application for extension of applicable interest rate of 11% on August 31, 2010: Date of the agreement prior to the change; August 31, 2010; date of the agreement prior to the change; August 31, 201; date of the change; date of the change; date of the change; date of the change; date of the change; Masan Development; Joint guarantor: Defendant;
E. The Korea Savings Bank shall be Daejeon District Court on February 28, 2012.
