A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, along with the names of the Chinese Telecommunications Fraud Group (N, etc.) and the sign-up account (O), received money from the victims to the pre-designated account by using a false advertisement that sells the virtual products on the Internet in China. On November 201, 2014, the Defendant: (a) issued a proposal to the effect that “I would deliver the money to the “O” located in Korea if I would be informed of the place and the amount of withdrawal of the passbook connected to the above account; and (b) if I would have the “O withdraw money from the account designated separately, I would make the money for 1% of the amount of withdrawal; and (c) I would like to withdraw money from the account designated separately.”

On January 13, 2015, the above fraud group’s name was false on the Internet, and the fact was transferred 7.50,000 won from the victim Q Q Q, who called “P”, to a new bank account in the name of another person (hereinafter “SU”) in the name of the victim Q, who had called “P,” despite the lack of intent or ability to sell Aphone 6 Pus, and called “P sales of Aphone 6 Pus to 7.50,000 won.” The victim Q, who had called for the said fraud group to report the purchase, was sent 7.50,000 won to the new bank account in the name of another person (hereinafter “SU”).

The members of the above telephone financial fraud group shall receive a total of 4,850,000 won from nine victims, such as the statement in the list of crimes in the attached Table, and the Defendant shall withdraw the remittance from the person who was not his name, and deposit the remittance into the “T’s U bank account in the name of T” and “V’s business bank W account.”
