A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

1. On January 27, 2015, the Defendant violated the Punishment of Violences, etc. Act (Habitual injury) was issued a summary order of KRW 3 million for the crime of bodily injury at the Cheongju District Court. On July 23, 2015, the Cheongju District Prosecutors' Office was issued a disposition not to prosecute the facts charged of the assault. On August 11, 2015, the Cheongju District Prosecutors' Office was issued a suspension of indictment on the facts charged of the destruction of property. On August 25, 2015, the Cheongju District Court issued a summary order of KRW 2 million for the crime of bodily injury. On September 8, 2015, the Cheongju District Prosecutors' Office received a summary order of KRW 3 million for the charges of the assault, without the right to prosecute, and on September 22, 2015, the Cheongju District Prosecutors' Office issued a fine of KRW 300,000,00 for the crime of causing property damage.

During several months prior to the Defendant’s expulsions with the victim C (Y, 49 years of age), the Defendant continued to inflict harm on the victim, such as the instant criminal records, and the victim did not hear the victim’s horses. Nevertheless, the Defendant tried to send text messages to the husband of the victim to threaten the victim, stating that the victim would inflict harm on the victim by finding the victim again who did not hear the victim’s horses and would end up the relationship between the Defendant and the victim’s husband.

On August 14, 2015, at the Defendant’s residence located in Cheongju-si, U.S., the Defendant: (a) using a mobile phone, “I can see bitch bitch bitch bitch bitch bitch bitch bitch bitch bitch,” and “I can am off when I can am off. I can am off. I am off. I can am off because I can am off. I can am off because I can am off. I am am off. I am we am off. I am we am off. I am we am off. I am we am we am off. I am we am we am we am off. I am we am we am we am bitch bitch bitch bitch bitch bitch bitch bitch bitch bitch bitch bitch,” and “I will send you son’s currency”.
