The Defendant is a business owner operating a game hall with the trade name of “E” on the D2 floor of the Masan-si Masan-si, Changwon-si, which was permitted by the Gu office of the Masan-si, and F is an employee working in the above game.

No game products-related business entity shall engage in gambling, other speculative acts, or leave game products to do so by using game water.

그럼에도 불구하고 피고인은 F와 함께 2018. 3. 23. 경부터 2018. 4. 16. 15:50 경까지 (F 의 가담 시기는 2018. 4. 1. 경부터 2018. 4. 16. 15:50 경까지에 한정된다) 게임 물관리 위원회로부터 등급 분류 받은 게임 물인 화룡성 게임기 20대, 흑룡성 게임기 30대, 스페 이 스쉽 2 20대, 투 맨 맞고 게임기 2대, 땡 큐 훌라 게임 기 2대 등 총 74대의 게임 물을 위 게임 장에 설치해 놓고 영업하면서, 그 곳을 출입한 손님들이 위 게임 물을 통해 획득한 결과물( 포인트) 10,000점 당 ‘E’ 의 상호가 기재된 명함 형태의 무기명 점수 보관 증( 이하 ‘ 점수 보관 증’ 이라 한다) 1매를 발부하고, 점수 보관 증에 금전적 가치를 부여하여 점수 보관 증을 소지한 손님이 다른 손님에게 점수 보관 증 3매를 현금 20,000원으로 교환할 수 있게 하고, 최초 점수 보관 증을 교부 받은 사람이나 이후 점수 보관 증을 구매한 손님들이 피고인 또는 F에게 이를 제시하면 점수 보관 증을 회수하고 피고인 또는 F가 소지한 현금 10,000 원권을 지폐 투입구에 넣어 점수 보관 증 1매 당 게임 점수 10,000 점을 게임기에 입력시켜 주었다.
