Reasons
1. Facts of recognition;
A. On February 16, 2015, the Plaintiff entered into an international marriage brokerage contract (hereinafter “instant contract”) with the Defendant with the effect that “the Plaintiff shall act as a broker for the Defendant’s international marriage, and the Defendant shall pay the Plaintiff a total of KRW 13 million with the intermediate payment of KRW 2 million on February 16, 2015, KRW 4.5 million on April 10, 2015, KRW 4.5 million on October 8, 2015, the remainder of KRW 4.5 million on October 8, 2015, and KRW 13 million on October 2015, the Plaintiff entered into an international marriage brokerage contract (hereinafter “instant contract”).
B. The schedule of international marriage events attached to the contract of this case (hereinafter “the schedule of this case”) states that “the defendant shall bear USD 1,200,000 in the new Korean language education expenses (private teaching institute expenses, transportation expenses, etc.) in addition to the above KRW 13 million, and 2,000 in the face-to-face-to-face-to-face-to-face-to-face-to-face-to-face-to-face-to-face-to-face-face-to-face-face-to-face-face-to-face-face-face-to-face-face-face-to-face-day marriage, marriage,
C. At the time of the instant contract, the main contents of the International Marriage Brokerage Standard Terms and Conditions (No. 5, hereinafter “instant Terms and Conditions”) issued by the Plaintiff to the Defendant are as follows.
Article 3 (Definition of Terms) (5) The term "marriage of marriage" means a case where a member confirms his/her intention of marriage with the opposite party and completes a marriage ceremony or other equivalent wedding after having entered into the same place, and a business operator shall be deemed to be a marriage relationship with the opposite party under the mutual consent of the member.
Article 6 (Duties of Business Operators) (4) Business operators shall provide members with the personal information of the opposite contractual party in writing before the schedule for international marriage events is determined.
Provided, That if the number of persons of the opposite party is added at the request of a member after departure or through consultation between a member and a business operator, the business operator shall provide the additional personal information of the opposite party in writing to the member prior to the arrival of the additional marriage.
