1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Summary of the plaintiff's assertion
A. Claim 1) The Defendant was in an internal relationship with C, a spouse of the Plaintiff’s de facto marital marriage. However, in recognition of the relationship with C on June 14, 2013, upon the Plaintiff’s knowledge of such circumstance, the agreement that “any act connected to C, such as e-mail, hosting, Internet, correspondence, contact, and correspondence, shall not be performed, and in the case of only one way, KRW 60 million shall be paid to the Plaintiff. In addition, the agreement that “The Plaintiff will pay KRW 20 million to the Plaintiff by June 30, 2015, on condition that the Plaintiff would not file a civil criminal complaint” (hereinafter “instant agreement”).
(2) However, the Defendant is obligated to pay to the Plaintiff KRW 80 million and damages for delay, in accordance with the terms and conditions of the agreement, since the Defendant continued to engage in C even after the agreement of this case.
B. Preliminaryly claiming consolation money, the Defendant has a duty to pay consolation money to the Plaintiff as consolation money for the amount of KRW 20 million and its delay damages, since the Defendant brought about mental pain to the Plaintiff, a de facto marital spouse, a de facto marital spouse.
2. Determination
A. 1) First, on June 14, 2013, whether the Defendant had entered into the instant agreement or not, and the evidence Nos. 1 and 2 (Agreement) as shown in the Plaintiff’s assertion are written in each of the above documents without the Defendant’s signature, seal, or seal (the Defendant’s name’s unmanned was confirmed to be inconsistent with the Defendant’s Unmanned as a result of the appraiser D’s appraisal, and there was no evidence to acknowledge that the above unmanned is the Defendant’s unmanned.
