Reasons
Punishment of the crime
The Defendant did not pay approximately KRW 30 million for the total amount of wages of four employees employed by the Defendant in the course of operating the Electric Construction Company C, which is an electrical construction company, and even if he received the payment from the victims of the electric extension work, he did not have any intention or ability to pay the payment prior to the payment for the electric extension work.
1. On May 23, 2016, the criminal defendant against the victim D refers to a false statement to the effect that “it is necessary to pay 7.2 million won to the victim in order to temporarily use 10kW electricity at the present place of business to 70kW from the F office for the victim’s operation in Sincheon-si, Ma.” On the same day, the criminal defendant received 7.2 million won from the victim to G account as the defendant’s child on the same day, and acquired 7.2 million won as the price for the extension of electricity.
2. On August 8, 2016, the Defendant against the victim H made a false statement to the effect that “In order to install the electric facilities of the head of the business and extend the temporary electricity to 50kW, 5,500,000 won need to be paid,” the Defendant received KRW 5,00,000 from the victim to the said G account on the same day, and received KRW 5,500,000 from the victim to the said G account on the same day, and received KRW 5,50,000 from the victim to the same account on the same day on August 12, 2016, and acquired KRW 5,50,000 in total.
3. On August 11, 2016, the Defendant: (a) made a false statement to the effect that “the Defendant would extend the victim’s 20kW electricity used in the factory to 35kW in the M office for the victim’s operation; (b) thereby, he/she received KRW 3 million from the victim to the N account in the name of the Defendant’s use on the same day; and (c) obtained the remittance of KRW 3 million as the price for the extension of electricity from the victim to the N account in the name of the Defendant’s use on the same day.
