Facts of recognition
원고는 도시 및 주거환경정비법(이하 도시정비법이라 한다) 제13조에 따라 정비기반시설이 열악하고 노후ㆍ불량 건축물이 밀집한 서울 성북구 C 일대 89,853.4㎡에서 주거환경을 개선하기 위하여 설립된 주택재개발 정비사업조합이고, 피고는 위 구역 내 별지 목록 기재 건물(이하 이 사건 건물이라 한다) 중 별지 도면 표시 ㅂ, ㅅ, ㅇ, ㅈ, ㅊ, ㅋ, ㅌ, ㅂ의 각 점을 순차로 연결한 선내 ㈏부분 87.4㎡(이하 이 사건 점포라 한다)에서 ‘D’라는 상호로 스포츠용품 및 운동기구의 도ㆍ소매업을 하고 있는 임차인이다.
The plaintiff was authorized to establish the association on April 21, 2009 from the head of Seongbuk-gu, the authorization to implement the project on April 4, 2013, and the authorization to implement the management and disposal plan on December 22, 2014, and was publicly notified on December 26, 2014.
On June 26, 2015, the Seoul Special Metropolitan City Regional Land Tribunal rendered a ruling to expropriate the building of this case for the above rearrangement project on June 26, 2015, and set the business compensation for the defendant at KRW 30,830,00.
On August 4, 2015, prior to the date of expropriation prescribed in the above ruling (on August 14, 2015), the Plaintiff deposited KRW 30,830,000 for business compensation with the Defendant as the deposited person.
【In the absence of dispute, Gap’s evidence Nos. 1 through 5 (including a branch number), the purport of the entire pleadings, and Article 49(6) and (3) of the Act on Urban Improvement of Urban Areas and Dwelling Conditions for Residents, if the management and disposal plans are authorized and publicly notified, the use and profit-making of the previous owner, lessee, etc. of the subject matter shall be suspended, and the project implementer may take over the subject matter and use it for profit-making (see, e.g., Supreme Court Decision 2009Da28394, Nov. 24, 2011). Accordingly, according to the above facts of recognition, the defendant is obligated to deliver the instant store to the plaintiff.
Whether the judgment on the defendant's assertion is null and void or not is against the plaintiff.
