The defendant's appeal is dismissed.

Summary of Grounds for Appeal

The defendant has not neglected his/her duty of care to prevent images of the victim.

Nevertheless, the judgment of the court below which found the defendant guilty is erroneous by misapprehending the facts and affecting the conclusion of the judgment.

The following facts revealed by the evidence duly adopted and examined by the court below, i.e., the victim consistently appeared to the extent that the Defendant, who is a physical therapy plant, did not wear away to the extent that it would be difficult at the time. However, the Defendant stated that the Defendant suffered pictures, such as water collection after receiving treatment, etc., and the Defendant stated that the Defendant did not take a part in the treatment plant, but the Defendant stated that the Defendant did not take part in the treatment plant. However, during the trial, the Defendant asserted that the Defendant’s statement was not consistent, such as the Defendant’s loss in the treatment plant and the reversal of the statement that he took part in the treatment plant.

However, according to the above evidence, it is only a statement to the effect that the victim did not state his/her loss at the time when he/she was investigated by the police, and that he/she appeared as a witness at the court of the court below and gave treatment.

② Since the victim complained of the occurrence of water collection by entering the hospital room immediately after receiving physical treatment as above, the president was diagnosed that he sent the image strings to the body, suffered pictures on the same side, and ③ the Defendant appears to have not taken necessary measures, such as periodically checking the status of the victim until the medical treatment was commenced by using an outboard medical device, etc., comprehensively taking account of the following: (a) the Defendant did not keep a certain distance between the Plaintiff and the return of the device while treating the victim by using an outboard medical treatment device, and continuing to show the status of the victim, and thus, can sufficiently recognize the fact that the victim suffered pictures.
