1. The plaintiff's appeal is all dismissed.
2. The costs of appeal shall be borne by the Plaintiff.
Purport of claim and appeal
The first instance court.
Reasons
1. The reasons for the acceptance of the judgment of the court of first instance are as follows, except for the addition of the following “2. additional determination” with respect to the assertion that the plaintiff emphasizes or adds to this court, and thus, they are cited by the main sentence of Article 420 of the Civil Procedure Act.
2. The plaintiff further determination shall be based on each of the land listed in the separate sheet by the defendants below "each of the land in this case."
B used the right to passage over surrounding land by exercising the right to passage over surrounding land. Since a new contribution to substitute roads on each of the lands of this case was established, the right to passage over surrounding land of this case was extinguished.
However, the former owner of each of the instant lands provided each of the instant lands as a passage road for the neighboring residents and renounced exclusive use rights thereto. The Plaintiff acquired ownership of each of the instant lands while the land category of each of the instant lands was a road and provided as a road for the passage of the neighboring residents. The Plaintiff cannot exercise exclusive and exclusive use rights as to each of the instant lands, and the Plaintiff cannot be deemed to have suffered any damage due to the passage of neighboring residents. The Defendants merely used each of the instant lands as a passage through the road and cannot be deemed to have exercised the right to passage over the surrounding land.
Therefore, the Plaintiff’s assertion that the Defendants are exercising the right of passage over surrounding land in each of the instant land is without merit, without any need to further examine.
3. The judgment of the first instance court is justifiable, and all of the plaintiff's appeal is dismissed.
