(a) order each real estate listed in the separate sheet;
(b) Appendix 1.
Reasons
1. Basic facts
A. The Plaintiff and the Defendants-related Plaintiff married with D on February 11, 1998, and was sentenced to a judgment of conviction for seven years due to murder by murdering D on March 12, 2008.
At the time of death of D, there was Defendant B, not only the husband but also the husband of the Plaintiff, who was a child born between the husband and the former husband E.
Defendant C is an external baby of Defendant B.
B. The registration and use relation of each real estate listed in the separate sheet (hereinafter “each real estate of this case”) 1) the real estate listed in the separate sheet 1 (hereinafter “the apartment of this case”).
(2) On May 9, 1997, the real estate listed in paragraph (2) of the Attached List No. 2 had been registered for ownership transfer on April 6, 199, respectively. The real estate listed in paragraphs 3 and 4 of the Attached List No. 3 and the registration for ownership transfer was completed on August 16, 2001, respectively. (2) The Plaintiff and D operated the telecom with the real estate listed in the Attached List No. 2, 3, and 4 (hereinafter “the instant telecomto”) from July 2001 to March 13, 2008, and Defendant B continued to occupy and use the apartment of this case while occupying and using the apartment of this case.
3) On January 19, 2009, Defendant B completed the registration of transfer of ownership by inheritance on March 12, 2008 with respect to the instant apartment, and on December 11, 2008, Defendant C completed the registration of transfer of ownership by inheritance on April 11, 2008 with respect to the instant apartment. Defendant C completed the registration of transfer of ownership on January 19, 2009 with respect to the instant apartment, on January 16, 2009, based on the pre-sale agreement as of January 19, 2009, the provisional registration on the same day was cancelled by the cancellation as of February 20, 2009; ② the registration of transfer of ownership was completed by the same day on the same day on the grounds of pre-sale as of February 20, 2009; ③ the registration of transfer of ownership was cancelled by the cancellation on the same day on the grounds of the pre-sale agreement as of September 19, 2009.
