Defendant shall be punished by a fine of one million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

The Defendant is a business owner who operates a service business (Aluminium repair business) in Yongsan-gu Seoul Metropolitan Government. The Defendant is a person who is responsible for the safety and health management of workers working at the Dong site, who is awarded a contract from E to KRW 5,000,000 of the construction cost of the Yongsan-gu Seoul Metropolitan Government D for the replacement project for the roof of Yongsan-gu D rooftop located in Yongsan-gu, Seoul.

A person who removes or dismantles a structure or facility containing asbestos shall comply with the standards for works for dismantling or removing asbestos prescribed by Ordinance of the Ministry of Labor.

Nevertheless, at around 15:30 on April 28, 2017, the Defendant removed asbestos slates containing 8% of asbestos in Yongsan-gu Seoul Metropolitan Government, and failed to establish a plan for dismantling and removing asbestos, and did not put up a sign informing that asbestos is being dismantled and dismantled, the Defendant did not provide personal protective equipment to the above employees, and did not control workers and employees who have not wear protective equipment, and did not prohibit workers from smoking and taking food inside the workplace, and did not install sanitary facilities, such as smoking rooms, shower rooms, and working clothes, in neighboring places, and did not work as damp in the process of dismantling and removing asbestos, and did not put the residuess, etc. containing asbestos generated during the work in vinyl, etc., and did not take measures to prevent scattering of asbestos through damping, etc.

As a result, the Defendant did not comply with the working standards for dismantling or removing asbestos under the Ordinance of the Ministry of Labor while removing or dismantling buildings or equipment containing asbestos.
