Reasons
1. Basic facts
A. The Plaintiff operates a factory that operates metal processing business, etc. (hereinafter “Plaintiff factory”) with the name of D in the building located in Busan Seo-gu, Busan. The Defendant Jung-gu, Inc. (hereinafter “Defendant Company”) is a company that occupies and uses the first floor of the building located in the neighboring G (hereinafter “instant building”) for the purpose of manufacturing, selling, etc., such as paint, using F, etc. from the first floor of the third floor building located in the building located in E adjacent to the Plaintiff factory to F, and the Defendant B is the owner of the instant building.
B. On November 9, 2013, the instant building possessed by the Defendant Company and the Plaintiff Company’s fire around 02:00 (hereinafter “instant fire”). As a result, the Plaintiff’s construction and machinery, fixtures, etc. stored in the Plaintiff’s factory building and the Plaintiff’s machinery, fixtures, etc. stored in the factory building were destroyed.
C. On November 25, 2013, at the request of the Busan National Police Station, the Korea National Research and Investigation Agency appraised the point and cause of the fire in this case, and the main contents are as follows.
