A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On December 2, 2014, the defendant prepared a false complaint against F at the defendant's house located in Busan Southern-gu E.

The Defendant Nonparty borrowed KRW 120 million from the Defendant (hereinafter “Defendant”) on March 4, 2013, and created a right to collateral security (hereinafter “right to collateral security (hereinafter “right to collateral security”) with a maximum amount of KRW 126 million against the land and the building on the south-gu Busan, Busan. At the time of borrowing KRW 120 million from the Defendant Nonparty Nonparty, the Plaintiff was paid KRW 60 million out of the loan amount of KRW 120 million, and the remainder of KRW 60 million was to be supplied as goods, but the Defendant Nonparty did not perform the promise, and subsequently, borrowed KRW 60 million out of KRW 120 million from the Defendant Nonparty Nonparty on April 1, 2013 to KRW 130 million on the ground that he borrowed KRW 43 million from the Defendant Nonparty Nonparty Nonparty and then borrowed KRW 43 million from the Defendant Nonparty Nonparty on the ground that he did not discharge his obligation to the Plaintiff on April 1, 2013.

However, the Defendant, on March 4, 2013, intended to borrow KRW 120 million from F from the Defendant to the Defendant’s account and received KRW 60 million on the same day, and affixed the following seals.

The Defendant received KRW 60 million in total, including one copy of the KRW 20 million check from G, which is the F’s partner (delivery to H upon request of the Defendant), KRW 31 million, one copy of the check, and KRW 9 million in cash, and subsequently received KRW 120 million in total. On March 31, 2013, he/she additionally borrowed KRW 50 million from G, which is the F’s partner, and received KRW 43 million after deducting advance interest, etc., as well as KRW 120 million, which was remitted to F on April 15, 2013.
