1. The Defendants jointly pay to the Plaintiff KRW 24,096,70 and the interest rate thereon from July 25, 2019 to the day of full payment.

1. Facts of recognition;

A. From August 2018 to November 2018, the Plaintiff supplied lighting fixtures to Defendant B Co., Ltd. (hereinafter “Defendant Company”). Accordingly, the Plaintiff did not receive KRW 34,096,700 from the Defendant Company.

B. On January 16, 2019, a letter of payment for the following (hereinafter “instant letter of payment”) was drawn up:

2. Determination as to the cause of action

A. According to the above facts, we examine the part of the defendant company. The defendant company is obligated to pay 24,096,700 won for the goods at the request of the plaintiff and damages for delay.

B. Defendant C’s personal information is indicated on the upper page of the instant payment angle, ① the Defendant C’s personal information is indicated on the front page of the instant payment angle, ② the Defendant C’s personal information is indicated in the middle of the instant payment angle, ② the Defendant’s commitment to comply with the said principal’s obligation. ③ In full view of the following: (a) the Plaintiff consented to the issuance and perusal of various certificates of taxation, resident registration, etc. when the payment is unpaid; and (b) the Plaintiff consented to the provisional attachment of the Plaintiff’s property if it is necessary to secure the Plaintiff’s credit before the due date; and (c) the Plaintiff’s objection is not raised if the payment is not made by the due date; (b) even if the Plaintiff’s personal information is affixed on the front page of the instant payment angle, the Defendant C’s goods are excluded in light of the content of the instant payment note, and the Defendant’s goods are difficult to be paid to the Plaintiff.
