Defendant shall be punished by a fine of KRW 9,000,000.
If the defendant does not pay the above fine, 100,000 won shall be one day.
Reasons
Punishment of the crime
On November 29, 2016, the Defendant was issued a summary order of a fine not exceeding three million won for a crime of violating the Road Traffic Act (drinking driving) by the District Court of the Republic of Korea.
On February 18, 2017, the Defendant driven a road at approximately 200 meters in front of 101 East apartment, located in Bi40-ro 452, from the point of drinking 0.213 percent alcohol concentration in the blood, to the point of 100 meters in front of 101 East apartment, located in Bi40-ro 452.
Summary of Evidence
1. Statement by the defendant in court;
1. A protocol concerning the examination of the police officers of the accused;
1. Statement of the circumstances of the driver involved in driving;
1. Inquiries about the results of crackdown on drinking driving;
1. License register;
1. Previous convictions in judgment: Application of a reply to inquiry, such as criminal history, and application of Acts and subordinate statutes to investigation reports (Attachment to judgment);
1. Article 148-2 (2) 1, Article 44 (1) (the point of drinking), Article 152 (1) and Article 43 of the Traffic Act concerning facts constituting an offense;
1. Articles 40 and 50 of the Criminal Act of the Commercial Competition;
1. Selection of an alternative fine for punishment;
1. Article 70(1) and Article 69(2) of the Criminal Act to attract a workhouse;
1. The Defendant, on the grounds of sentencing of Article 334(1) of the Criminal Procedure Act, driven without a license in a state of alcohol concentration in the blood alcohol concentration of 0.213%.
In addition, a fine of 3 million won was already issued due to drinking driving, and a fine of 2 to 3 months was issued.
However, the defendant has not been subject to criminal punishment other than the above fine until now, and is in depth.
In addition, the punishment as ordered shall be determined in consideration of the age, sex, environment, attitude after the crime, etc. of the defendant.
