The plaintiffs' claims against the defendants are dismissed in entirety.

The costs of lawsuit shall be borne by the plaintiffs.

1. Basic facts

A. Plaintiff B and C are the parents of Plaintiff A, and Plaintiff D is the punishment of Plaintiff A.

Plaintiff

On June 13, 2016, A entered the Republic of Korea Marine Corps, and was assigned to the Second Group of the Marine Corps and served as a monitoring equipment operating soldier. Defendant E, F, and G (hereinafter “Defendant E”) were the appointed soldiers of Plaintiff A.

B. From July 2017, Plaintiff A had a mental disorder from around July 2017, and around August 2017, Plaintiff A was judged as Grade V, physical or mental disorder diagnosis, physical or mental disorder grade 5, Grade VII, and Grade III, and finally discharged Plaintiff A from active service on the ground of his/her major on September 30, 2017.

C. On October 25, 2017, Plaintiff A received KRW 8,333,910 as compensation for disability under the Military Pension Act.

2. Summary of the parties' arguments

A. The Plaintiffs were subject to the following harsh acts by Defendant E, etc., and the commander of the affiliated military unit of Plaintiff A also neglected his duties by neglecting the Plaintiff A by failing to take appropriate measures to prevent harsh acts by Defendant E, etc. and the occurrence of the Plaintiff’s mental illness.

Such illegal acts have occurred in relation to the performance of duties of the defendant's Republic of Korea, and as a result, the plaintiff A suffered from mental illness.

Therefore, pursuant to Article 2 (1) of the State Compensation Act, Defendant E, etc. is jointly liable for tort, and Defendant E, etc. is obligated to pay damages of KRW 5 million for consolation money and KRW 20 million for consolation money and KRW 10 million to Plaintiff A, Plaintiff B, and Plaintiff C, respectively, based on the tort liability.
