1. The instant lawsuit was concluded on October 22, 2020 as the withdrawal of the lawsuit.

2. The costs of lawsuit which have arisen after the lawsuit is completed.

We examine ex officio the termination of the instant lawsuit.

When a person who has raised an objection to a distribution schedule fails to appear on the first date for pleading of a lawsuit of demurrer against distribution (Article 158 of the Civil Execution Act). The fact that the Plaintiff had been absent on October 22, 2020, the first date for pleading, even after receiving the notification of legitimate date after filing a lawsuit of demurrer against the Defendant, is apparent in the record.

Therefore, even though the lawsuit of this case was withdrawn due to the Plaintiff’s absence on the first date for pleading, the litigation of this case is unclear, such as submitting an application for change of date to the Plaintiff. Thus, this court rendered a declaration of termination of the lawsuit in order to clarify the termination of the lawsuit of this case by the Plaintiff.
