1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Based on the facts, the plaintiff and his wife purchased each of the real estate of this case between the Ansan-gu D 189.9 square meters and its ground (hereinafter "each of the real estate of this case") in the voluntary auction procedure commenced to the Suwon-gu District Court E on December 20, 2001, and the Suwon-gu Saemaul Savings Depository (hereinafter "Yanyang-gu Saemaul Savings Depository") on December 20, 2001. The plaintiff entered into a contract to purchase the real estate of this case with the Ansan-gu Saemaul Savings Depository in the name of the defendant on January 10, 202. The plaintiff paid all of the above purchase price to the Gyeyang-gu Saemaul Savings Depository over several occasions from around that time to January 28, 2003.

From August 20, 2002, the Plaintiff borrowed bills from the Defendant to raise funds for purchasing each real estate of this case on several occasions. As of September 27, 2003, the Plaintiff did not perform the agreement with the Defendant on November 1, 2003, “10,000,000 won out of the principal and interest of the above loan amount of KRW 80,000,000,000,000,000 from November 5, 2003, the remainder of KRW 70,000,000, monthly interest rate of KRW 1,40,000,000 from November 10, 2013, to the principal amount of KRW 5,00,000 from the end of February 27, 2004.”

The Plaintiff borrowed or borrowed cash from the Defendant from January 2002, in addition to the above borrowed bills, and as of April 26, 2004, the total amount of the principal and interest of the borrowed amount resulted from KRW 54,280,000. As of April 27, 2004, the Plaintiff agreed to pay the above borrowed amount of KRW 151,365,000 (i.e., the total amount of the principal and interest of the borrowed amount of KRW 97,085,00) as of April 26, 2004 (i.e., the borrowed amount of KRW 54,280,00) and agreed to pay the above principal and interest of the borrowed amount of KRW 151,365,00 (i.e., the borrowed amount of KRW 97,085,00) by the end of May 26, 2004.

After that, the plaintiff is the defendant on June 29, 2004.
