A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Around August 6, 2015, the Defendant posted a notice of the victim C’s purchase of a 510 (bicycle speed gauge) civil servant on the Internet NAVER’s bulletin board at his own house located in Donnam-gun, Donnam-gun, and then contacted the victim in writing. The Defendant, despite having no intention or capacity to sell the above goods, said goods were sold, said goods were falsified as if they were sold to the victim, and then the Defendant acquired them by transfer KRW 360,000 from the victim to the Agricultural Cooperative (E) account in the name of the Defendant designated by the Defendant.
From August 16, 2015 to September 29, 2015, the Defendant: (a) reported the fact that the Victim F was to purchase a arche vehicle on the Internet’s bulletin board, and contacted the victim; and (b) falsely sent money to the victim despite the absence of intent or ability to sell the said goods; (c) received money from the victim’s own Gwangju Bank account (G) 77,000 won from the said date to September 29, 2015; and (d) obtained money from the victim from the said date and time to September 29, 2015 by means of the above total of KRW 2,905,000 through 11 times, as shown in the attached Table 1 of Crimes.
Around September 22, 2015, the Defendant posted a notice of the purchase of the victim H in the Internet NA B’s website on the Internet NAB B’s website in his/her residence located in Donnam-gun, Jeonnam-do. The Defendant contacted the victim in writing on the victim’s website. As such, the Defendant, despite having no intent or capacity to sell the above goods, fraudulently embling the said goods as if he/she were to sell the goods, received KRW 4.50,000 won from the said victim’s agricultural bank account in his/her name, and received KRW 4,025,00 won in total over 11 times, as in the attached Form 2 Crime List.
The defendant of "2015 Highest 505" is located in B of Jeonnam-do around September 10, 2015.
