The defendant's appeal is dismissed.

1. The summary of the grounds for appeal is that the court below erred by misapprehending the fact that the defendant was guilty, although the defendant did not assault the victim.

2. According to the evidence duly adopted and examined by the lower court, the following facts charged against the Defendant can be fully acknowledged in light of the following: (a) the victim consistently states the fact of damage from the investigation period to the court of the lower court; (b) the victim’s statement cannot be found to be contradictory to the victim’s statement; and (c) the victim’s photograph and the statement of the victim’s injury diagnosis as to the victim’s statement corresponds to the victim’s statement.

3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act since it is without merit. It is so decided as per Disposition.
