1. The Defendant (Counterclaim Plaintiff) paid KRW 304,324,724 to the Plaintiff (Counterclaim Defendant) and its amount from May 11, 2019 to June 20, 2019.
Reasons
1. Basic facts
A. The Plaintiff is the owner of Gangnam-gu Seoul Metropolitan Government Cbuilding (hereinafter “instant building”).
The purpose of the public register at the time of completion of the construction of the first and second floor of the instant building was warehouse facilities among neighborhood living facilities, but it has been used as a bath until now since the change to a bath on November 10, 1997.
Article 2 (Restriction on Use) A lessee shall rent a leased object to use it for public bath purposes, and shall not use it for other purposes.
Article 3 (Term of Lease Contract) (1) The term of lease contract shall be from June 15, 2011 to October 31, 2014.
Provided, That the term of the lease contract shall be deemed to have been extended for one year under the same conditions as this contract, except for the provisions on deposit, rent, and management expenses, if no written notice of the expiration of the contract is given by either of the parties 30 days prior to the expiration
The same shall also apply to the extension or reconstruction.
Article 4 (Lease Deposit) (1) A lessee shall deposit 170,000,000 won per day with the lessor as a rental deposit at no interest rate.
Article 5 (Rents and Maintenance Expenses) (1) A lessee shall pay rent and maintenance expenses for each month prescribed in Article 5 (2) to a lessor by the end of each month.
Provided, That where the last day is a public holiday, it shall be paid by the following day.
(3) If the contract period commences or terminates at the middle of the month, the monthly rent for the divided month is calculated as of the beginning date of the contract or the end date of the contract.
(4) With respect to the electricity charges, water supply and sewerage charges, environmental improvement charges and charges for causing traffic congestion, etc., other than the basic building management and maintenance expenses of a lessee, if necessary, in accordance with the method separately computed by the lessor.
